Drew Peterson lost his attempt Wednesday to have two felony weapons charges dismissed, but his attorneys said they're confident he'll win when the case goes to trial.

A Will County judge rejected an argument by Peterson's attorneys that federal law allows the retired Bolingbrook police officer to own the assault rifle that prompted his arrest.

The ruling by Judge Richard Schoenstedt clears the way for Peterson -- who has been labeled a suspect in his fourth wife's 2007 disappearance -- to stand trial later this year on charges he possessed an AR-15 assault rifle with an illegally short barrel.

Peterson, 54, faces a maximum five-year prison term if convicted.

"The prosecution is continuing, so it's not a total victory," defense attorney Joel Brodsky said, but he added: "There are many positive aspects to this [ruling]."

Schoenstedt could set a trial date when Peterson next appears in court Aug. 28.

Prosecutors praised the ruling, saying they're eager to take the case to trial.

"We're just pleased we can move forward with the case," said Charles Pelkie, a spokesman for Will County State's Attorney James Glasgow.

The weapons charges are the only ones filed against Peterson, whose fourth wife, Stacy, disappeared last October.

Authorities have also reopened their investigation into the 2004 drowning death of Peterson's third wife, Kathleen Savio. Her death, initially ruled an accident, was reclassified a murder after Stacy Peterson's disappearance.

State Police seized the assault rifle and other weapons last November during a search of Peterson's Bolingbrook home. It wasn't until May that prosecutors filed the first weapons charge against him, alleging the barrel of the AR-15 is shorter than the 16-inch limit set by state law. They added a second charge in July, contending Peterson transferred the illegal weapon to his adult son Stephen.

Peterson's attorneys, though, argued the gun charges should be dismissed because a 2004 federal law allows police officers nationwide to own and carry weapons, regardless of state laws.

"It would be an illegal gun for a non-police officer," Brodsky said.

Prosecutors disputed that, arguing that even with the federal law, police officers can't carry weapons that are illegal under state law.

Though Schoenstedt refused to dismiss the weapons charges, he indicated the crucial issue in Peterson's trial may be whether the federal legislation supersedes state gun laws -- and said he has found no clear answer to that question.

Peterson, who remains free on bail, declined to comment as he left the courthouse, but he waved to several spectators

Ex-cop suspected in wife's disappearance faces felony weapons counts

Former Bolingbrook Police Sgt. Drew Peterson will face felony gun charges stemming from the investigation of his wife's disappearance, after a Will County judge Wednesday denied a request to throw out the charges.

In his ruling, Judge Richard Schoenstedt said Peterson's legal team had failed to prove a federal statute permitted him as a law-enforcement officer to have a modified weapon that is illegal in Illinois.

"For the defense to be successful at this stage, this court would be required to make certain assumptions on behalf of the defense and against the state," Schoenstedt said. "Given the burden as described, this court declines to do so."

At question is a modified assault rifle with a barrel nearly 5 inches shorter than allowed by state law, officials said. The rifle was seized last fall after search warrants were executed as part of the investigation into the disappearance of Peterson's fourth wife, Stacy. The Bolingbrook mother, who was 23 at the time, vanished Oct. 28, and police named Drew Peterson, 54, a suspect in the case.

In May, shortly before Peterson was to regain possession of the weapons taken by state police, Peterson was arrested on the gun charges.

Earlier this month, Peterson's attorneys had argued that since he used the rifle while he was a police officer in Bolingbrook, he was exempt from state law under the federal Law Enforcement Officers Safety Act of 2004, or LEOSA.

The federal law permits working and retired law-enforcement officers in good standing to carry a concealed firearm in any jurisdiction in the U.S., regardless of most state or local laws.

Schoenstedt agreed that it did apply to Peterson as a qualified police officer. But he said he could not find a prior case or law that addressed whether the legality of the firearm mattered under the federal statute, or whether there was a difference between concealing and carrying a weapon, which is protected by the statute, or possessing it, which is what Peterson is charged with.

"Obviously the prosecution is continuing, so it's not a total victory," Peterson's attorney Joel Brodsky told reporters after the hearing. "But when you read the judge's decision, there are many positive aspects. What he did is say that the LEOSA law does apply, it does cover Drew Peterson's situation."

Peterson's attorneys said they are confident that their client will be vindicated in court. They have said they have paperwork from the Bolingbrook Police Department proving that it knew Peterson used the gun as a secondary duty weapon.

MEGYN KELLY, FOX NEWS HOST: Well, Drew Peterson lawyers are here to respond to the shocking, most recent allegations about their client. Two close friends say Drew's say they wore wires and secretly taped their private conversations with Drew Peterson.

According to the couple, who went "On the Record" on Monday, Drew makes incriminating statements on the tapes about the disappearance of his fourth wife Stacey and about the murder of his third wife Kathleen Salvio.

Meanwhile, today, Peterson's troubles continue to grow. A judge in Illinois refusing to drop gun charges against the former police sergeant.

Joining us live tonight are Drew Peterson's lawyers, Joel Brodsky and Andrew Abood. Good evening, gentlemen.

JOEL BRODSKY, ATTORNEY FOR DREW PETERSON: Good evening.

ANDREW ABOOD, ATTORNEY FOR DREW PETERSON: Good evening.

KELLY: Joel, let me ask you about this decision today to let the gun charges stand. I guess it is not entirely unexpected. What happens now?

BRODSKY: Unexpected--we were hoping for a complete dismissal. But the judge found--there were three factors which we moved to dismiss, and the judge found two of them in our favor and said that the third one will have to be resolved at a trial. It's a factual issue, and that is where factual issues are resolved, at trial.

But we prevailed on two of those three prawns(ph) of dismissal, and we're confident-

KELLY: So now you proceed to the evidentiary phase. How much time, Andrew, is Drew Peterson facing on these gun charges?

ABOOD: I think it is a five year felony.

KELLY: Five years in prison if he were to be convicted.

ABOOD: That would be the maximum penalty. It is unlikely that he would see anywhere near that time, given his lack of criminal history.

KELLY: OK.

And, Joel, I want to get you to react tonight, because we had on this couple who we talked about in the introduction, Len Wawczak and Paula Stark, who wore wires, who taped Drew, and they said on this program on Monday that they think they have enough incriminating evidence to put him in prison for the murder of his third wife Kathleen and, they believe, for what they thing is the murder of his fourth wife, Stacey. Your response, Joel?

BRODSKY: I am going to let Andy handle a lot of this, but my initial response is we're not afraid of whatever may be taped. They can play the tapes. The tapes will speak for themselves. But as to these people's credibility, let Andy handle to that.

ABOOD: We have heard those statements, Megyn, and it is clear that not only has he retracted from the statements he is alleged that Drew made, but he is clearly not the material witness he would like to make himself out to become. And we believe, ultimately, he is not a factor in their investigation whatsoever.

KELLY: What do you mean he has retracted his position?

ABOOD: Well, he was on news media sources as early as Monday retracting statements that he attributed to Drew Peterson.

KELLY: Could you be more specific?

ABOOD: The statement where he attributed to Drew that he should have cremated his third wife.

KELLY: Because he was on this program with Paula, and they reiterated that he had made this statement. Paula, in particular, had said that Drew said he should have cremated Kathleen's body, and then he wouldn't have had to deal with--

ABOOD: He never made those statements, and they will never produce a tape that says he made those statements.

KELLY: Joel, let me get you to weigh in on this, because I asked them about your denial that Drew had ever made those statements, and they called you "Jailhouse Joel," and said you have to consider the source. I want to give you the chance to respond.

BRODSKY: I am not going to go down in the gutter with Mr. Wasczak. That is where he belongs, not me.

But, for example, what Andy was saying was that Len had said initially that that was on tape, the statement about cremation, and then later on he said maybe it was not on tape, maybe he said it off of tape.

So he wavers back and forth on issues, and they are just not credible people.

ABOOD: Let me just add, one thing that I could add is that everything that Joel has told the media about this case and about these charges has turned out to be true.

And if you go back to May 23 when we were outside the courthouse, Joel told the press and the media that the record would show that this was a secondary-duty weapon of Drew Peterson. And, despite the fact that the Bolingbrook Police Department was denying that they had any knowledge of it-

KELLY: Understood.

ABOOD: And it all came out to be true.

KELLY: Understood. Joel, Andrew, thanks so much for being here.

ABOOD: Thank you.

Jennifer Schoon, the former girlfriend of Drew Peterson’s son Steve testified before the grand jury Thursday.

Schoon and her attorney Thomas Glasgow exited the Will County Court Annex building at about 12:45 p.m.

“(Schoon) was the girlfriend of Steve Peterson and lived in the house with Drew Peterson and Steve Peterson during the time that Kathleen Savio’s body was discovered,” Glasgow said.

Glasgow said Schoon testified extensively but declined to comment on the content of the testimony.

I am most certain they are brothers. James and Tom Glasgow…went to school with them in Joliet.

Also, Jennifer Schoon, ex-live in girl friend of Steve’s….I remember hearing they broke up because he cheated and or abused her?? Anyone else remember this?
